Terms of Use

These terms ("Terms") govern your use of the Melo app and website (together, the "Service"), operated by Stephan Kop ("we", "us"). By installing or using Melo, you agree to these Terms. If you don't agree, please don't use the Service.

1. Your account

You need an account to use Melo. Keep your sign-in credentials secure. You're responsible for activity on your account. You must be at least 13 years old to use Melo.

2. License to use Melo

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Melo on Apple-branded devices that you own or control, for non-commercial personal use, subject to these Terms and the Usage Rules in Apple's Media Services Terms (see also section 13(b) below).

You own the journal entries, photos, and other content you create in Melo ("Your Content"). You grant us a limited license to store and process Your Content on our servers and through our service providers for the sole purpose of providing the Service to you (including generating the audio tracks from your entries).

We do not use Your Content to train models, sell it, or share it with anyone other than the providers needed to run the Service, as described in our Privacy Policy.

5. Generated audio

The audio tracks Melo generates from your entries are for your personal use. You may listen, save, and share them privately. You may not use them as backing tracks for commercial content (advertising, paid music releases, etc.) without our written permission.

You can stop using Melo and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms. On termination, your account and entries are deleted in line with our Privacy Policy.

8. Disclaimers

The Service is provided "as is." We do not promise it will be uninterrupted, error-free, or that the generated audio will meet any particular expectation. Melo is a journaling tool — it is not medical, psychological, or therapeutic advice.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

10. Changes

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you in the app. Continued use of the Service after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Netherlands. Disputes will be heard in the competent courts of the Netherlands, unless mandatory consumer-protection laws of your country of residence say otherwise.

13. Apple-specific terms

The following additional terms apply to your use of Melo on Apple devices and form part of these Terms.

(a) Acknowledgment. These Terms are between you and us only, and not with Apple Inc. ("Apple"). Apple is not responsible for Melo or its content. To the extent these Terms provide for usage rules or contain other terms that are less restrictive than, or in conflict with, the Apple Media Services Terms in effect as of the date of your acquisition of Melo (the "Usage Rules"), the more restrictive or conflicting Apple term shall control.

(b) Scope of license. The license granted to you for Melo is limited to a non-transferable license to use Melo on any Apple-branded product that you own or control and as permitted by the Usage Rules, except that Melo may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

(c) Maintenance and support. We are solely responsible for providing any maintenance and support services with respect to Melo, as specified in these Terms or as required by applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Melo.

(d) Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Melo to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Melo to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Melo. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

(e) Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Melo or your possession and use of Melo, including: (i) product liability claims; (ii) any claim that Melo fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.

(f) Intellectual property rights. In the event of any third-party claim that Melo or your possession and use of Melo infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual-property infringement claim.

(g) Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

(h) Developer contact information. Any questions, complaints, or claims with respect to Melo should be directed to: Stephan Kop, Prinses marijkestraat 33, 2404BA Alphen aan den Rijn, The Netherlands, hello@melo-journal.nl.

(i) Third-party terms. You must comply with any applicable third-party terms of agreement when using Melo (for example, your wireless data service agreement).

(j) Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
